Subject: Notary Fees 7/15/02
A question that is often asked by notaries is, "how much can
I charge for my notary services?" and "is that fee for each signature
or for just the document?"
In Oregon, notaries can charge no more than $5.00 for most notarial acts performed. (OAR 160-100-0400) Taking an acknowledgement, verifying an oath or affirmation, certifying a copy of a document and witnessing a signature is only $5.00.
So how much can a notary public charge if there are three people wanting to have the notary witness their signatures on the same document? $15.00, $5.00 for each signature/person, or each act the notary performed. Even though the notary is using one certificate, the notary is identifying and witnessing three separate executions on the document.
When a notary administers an oath or affirmation without a signature, it is only $1.00. Also, a notary can charge no more than $1.00 per page for taking a deposition.
A notary also needs to remember that a schedule of the fees needs to be posted or the signer needs to be given a schedule, so she is aware what the fees are and agrees to them before the notarization.
If the notary signed the waiver of fees on his application, that means he can never charge for notarial services. But what if the notary doesn't remember about the waiver and wants to start charging? Simply contact our office at (503) 986-2593 or e-mail us at oregon.notary@state.or.us, and check your record. If the notary did sign the waiver and wants to start charging, send a letter rescinding the waiver of fees to the Secretary of State, Corporation Division at 255 Capitol St. NE, Ste. 151, Salem, OR 97310.
